Peter Boehlke, feinwerk, Carl-von-Linde-Straße 32, 85716 Unterschleißheim, Germany, e-mail: info@feinwerk.io
Data protection officer: Wolfgang Evers, DSZ GmbH, Brandlweg 5, 83543 Rott am Inn, Germany, phone: +49 152 2951 7648, e-mail: wolfgang.evers@dsz365.de
This policy applies to the Feinwerk Campaigns website, that is, the pages you are reading. The platform itself (the application you sign in to) has its own platform privacy policy.
2. Hosting and server log files
This website is operated on servers of Hetzner Online GmbH, Industriestr. 25, 91710 Gunzenhausen, in Germany (hetzner.com). Hetzner processes data only as far as needed to run the servers and on our instructions; we have concluded a data processing agreement with Hetzner (Art. 28 GDPR). When you visit, server log files are processed automatically (IP address, date and time, requested page, user agent, referrer). This serves stable operation and defence against attacks (Art. 6(1)(f) GDPR). Log files are deleted after 30 days at the latest, unless a security incident requires longer retention.
The connection to this website is encrypted with TLS (shown by "https://" and the lock symbol in your browser), so that third parties cannot read your input, for example in the pilot request.
We deliver fonts from our own server; no third-party fonts are loaded. This website uses no Google Ads and no other tracking or advertising services.
3. Pilot request
If you use the "Request a pilot" form, we process the data you enter:
- your role (company, agency or tracking provider),
- company, your name and your e-mail address,
- your answer to the question about your campaigns or clients (for example the number of clients),
- whether you use Matomo (yes, no or not sure),
- optionally your message,
- the language of the page you send the request from (German or English).
We use the data only to process your request and to contact you (Art. 6(1)(b) GDPR where you want to prepare a pilot, otherwise Art. 6(1)(f) GDPR). The data is sent to us by e-mail (info@feinwerk.io) and is not stored in a database of this website. The e-mail stays in our mailbox until the request is closed and no statutory retention duty prevents deletion.
To protect against automated requests, the form contains a hidden field and an encrypted timestamp carried in the form; the number of requests per IP address is limited for a short time. We do not pass the data on to third parties.
If you write to us directly by e-mail, we process your message and the data in it in the same way, only to handle your request and on the same legal bases; we do not pass it on without your consent.
4. Booking an appointment via Calendly
This website contains links for booking a demo appointment. The links lead to the booking page at Calendly (calendly.com). Nothing from Calendly is embedded or loaded on this website: data flows to Calendly only when you click the link. The booking page then opens in a new window.
The provider is Calendly, LLC, 115 E Main St., Ste A1B, Buford, GA 30518, USA. On the booking page you enter your name, your e-mail address and the appointment you want; Calendly processes this data and the technical connection data under its own privacy policy (calendly.com/privacy). We receive the booking in order to hold the appointment with you (Art. 6(1)(b) GDPR). A data processing agreement with Calendly is in place (Art. 28 GDPR); it is part of Calendly's customer terms. Using the booking page is voluntary; you can also arrange the appointment by e-mail or via the pilot request.
Calendly, LLC is certified under the EU-U.S. Data Privacy Framework. The transfer of your details to the USA is based on the European Commission's adequacy decision of 10 July 2023 (Art. 45 GDPR).
How the click on the booking link is counted in our web analytics is described in section 6.
5. Cookies and consent
Without your consent we set only cookies that are strictly necessary for this website to work as you request (section 25(2) no. 2 TDDDG):
- "feinwerk-campaigns-session" and "XSRF-TOKEN": session and protection of the pilot request against abuse, deleted two hours after your last page view at the latest.
- "fw_consent": stores your choice in the privacy settings for all Feinwerk websites on feinwerk.io (see below), twelve months.
We use all other cookies and similar technologies (such as your browser's local storage) only with your consent (section 25(1) TDDDG, Art. 6(1)(a) GDPR). You give or refuse it in the privacy settings, as on feinwerk.io: on your first visit a bar offers "Accept all" and "Reject" with equal prominence. There are two optional categories: "Statistics" (Matomo cookies, section 6) and "Marketing" (Google Ads, only on feinwerk.io; this website does not load Google Ads, details in the feinwerk.io privacy policy). With the link "Open privacy settings" in the footer and at the end of this policy you change your choice at any time. Your consent is voluntary and can be withdrawn at any time with effect for the future.
6. Web analytics with Matomo
To evaluate the use of this website statistically and to improve our offer, we use the open source software Matomo (matomo.org). Matomo runs on a server operated by us in Germany (data.feinwerk.io); the data is not passed on to third parties.
We record the pages viewed, date and time, time on page, the previously visited page (referrer), clicks on external links (such as the booking link in section 4), clicks on the booking and live demo links and your answer to "Was this page helpful?" as events, the sending of the pilot request as an event without your entries from the form, browser, operating system, device type, language and the approximate origin (country). Your IP address is shortened by its last byte before storage (for example 192.168.1.xxx). Raw data is deleted after six months; afterwards only aggregated statistics without reference to individual visits remain.
Without your consent Matomo sets no cookies. The legal basis is then our legitimate interest in analysing and improving this website (Art. 6(1)(f) GDPR).
With your consent to the category "Statistics", Matomo additionally sets cookies so that returning visits are recognised as such. The legal basis in this case is your consent (section 25(1) TDDDG, Art. 6(1)(a) GDPR). These are "_pk_id" (13 months), "_pk_ses" (30 minutes), "_pk_ref" (6 months) and "mtm_cookie_consent" (remembers your consent for Matomo for as long as your choice applies). If you withdraw it, these cookies are deleted and Matomo counts without cookies again.
One choice for all Feinwerk websites. This website and the other Feinwerk websites on feinwerk.io share your choice in the privacy settings as if they were one website: the cookie "fw_consent" applies to the whole feinwerk.io domain. If you agreed or declined on one of these websites, that applies here too and the bar does not appear again. If you change or withdraw your choice here, it applies to all of these websites. A category only takes effect where the service in question is used: "Statistics" on all Feinwerk websites, "Marketing" only on feinwerk.io.
You can object to the recording as a whole at any time (Art. 21 GDPR), informally by e-mail to the address above.
7. Links to the platform
From this website you can go to the Feinwerk Campaigns platform (app.campaigns.feinwerk.io), for example to sign in or to the live demo. From the click onwards the platform privacy policy applies.
Links to feinwerk.io and to the plugin store (plugins.feinwerk.io) lead to pages of the same provider with their own privacy policy.
8. Your rights
You have the right to access (Art. 15 GDPR), rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18), data portability (Art. 20) and to object to processing based on Art. 6(1)(f) GDPR (Art. 21). You can withdraw consent at any time with effect for the future (Art. 7(3) GDPR); the lawfulness of processing carried out until the withdrawal remains unaffected. Please contact the e-mail address above or our data protection officer, informally.
Right to object (Art. 21 GDPR): Where we process your data on the basis of our legitimate interest (Art. 6(1)(f) GDPR), you can object at any time on grounds relating to your particular situation. We then stop processing the data unless we can demonstrate compelling legitimate grounds that override your interests, rights and freedoms, or the processing serves the establishment, exercise or defence of legal claims.
9. Right to lodge a complaint
You have the right to lodge a complaint with a data protection supervisory authority, for example the Bavarian State Office for Data Protection Supervision (BayLDA), Promenade 18, 91522 Ansbach, Germany.
10. Retention
Unless this policy names a more specific retention period, we store your data only until the purpose of the processing ceases. If you make a legitimate request for erasure or withdraw consent, we delete your data unless statutory grounds (such as tax or commercial retention periods) prevent it; in that case we delete it as soon as those grounds cease.
